Terms of Service

1. Service Description

GamePC provides on-demand cloud machines, each with one dedicated NVIDIA GPU. A machine is a Linux container with PyTorch and CUDA preinstalled, accessed through JupyterLab in a web browser or over SSH; it has no display, graphical desktop, screen sharing or game streaming. Machines are provisioned on GPU hosts from our infrastructure providers and billed per second while running. GPU tiers are offered subject to availability and may be out of stock or temporarily paused.

2. Account Requirements

• You must be at least 18 years old to create an account.
• You must provide accurate and complete information during registration.
• We do not accept new sign-ups from Russia, Belarus, Iran, North Korea, Syria or Cuba: registration is refused from an IP address in these countries or when the email address, phone number or selected country belongs to one of them, and card payments with a billing country among them are refused. Existing accounts keep access to their account and balance.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.

Each account is one person's sign-in: there are no seats to manage and no shared team workspace. You may open and use it for yourself or for a studio, company or other organisation. When you use it for an organisation, that organisation is the customer under these terms and is responsible for the account and everything bought through it, and you confirm you are authorised to accept these terms on its behalf.

Rights that the law gives only to consumers, such as the statutory right to withdraw from an online purchase, apply to an individual buying for personal use and not to an organisation buying for its business. Everything our policies promise, including the refund of unused credits, applies to every customer alike.

3. Billing and Credits

• GamePC uses a prepaid credit system. Your balance is kept in US dollars: $1 of credit pays for $1 of machine time at the tier's hourly rate. You add credits to your account and usage is deducted per second while a machine is running.
• You pay in the currency you choose (USD, EUR, GBP, AZN or KZT). A single top-up can be any amount from €1 to €20,000, or its equivalent in the currency you pick at the day's rate (US dollars included), with the maximum rounded down to a round figure so it never exceeds €20,000. Card payments are processed by our payment processor.
• Unused credits are refundable within 14 days of purchase, to the original payment method, as set out in the Refund Policy: contact support@gamepc.io. Credits already used are not refundable.
• If your balance reaches zero, running machines will be automatically stopped to prevent negative balances.
• Machine state (disk, installed software) is preserved for 24 hours after stopping. After 24 hours, stopped machines and their data are permanently deleted, normally within the following hour.
• You are only charged while a machine is running. If a machine you deploy does not start within 10 minutes — for example because the GPU host it was assigned to fails — we cancel the deploy and release the host, and you are not charged for it. You can deploy again straight away.

4. Acceptable Use

You agree not to use GamePC for:

• Any illegal activity, including distributing malware, unauthorized access to other systems, or violation of applicable laws.
• Cryptocurrency mining or any form of blockchain proof-of-work computation.
• Distributed denial-of-service (DDoS) attacks or network abuse.
• Storing or distributing content that exploits minors.
• Reselling or sublicensing access to GamePC machines without authorization.
• Any activity that degrades the service for other users or damages infrastructure.

We may suspend or terminate accounts that violate these terms without prior notice. Unused credits bought in the last 14 days are still refunded as set out in the Refund Policy, except credits from a payment that was charged back or made fraudulently.

5. Service Availability

We do not guarantee uninterrupted service or any particular uptime. GamePC depends on third-party infrastructure (our infrastructure providers and their GPU hosts) and factors outside our control. If a running machine stops working because of a fault on our platform or on the GPU host it runs on, we credit the time you lost — contact support@gamepc.io with the machine ID and we will apply it to your balance.

6. Limitation of Liability

To the maximum extent permitted by law, GamePC and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising from your use of or inability to use the service.

Our total liability for any claim arising from the service is limited to the amount of credits you have purchased in the 12 months preceding the claim.

7. Termination

• You may close your account at any time by contacting support.
• We may suspend or terminate your account immediately if you violate these terms, engage in abusive behavior, or fail to maintain a valid payment method when required.
• Upon termination, any running machines will be stopped and data will be deleted. Unused credits bought within the previous 14 days are refunded on request, as set out above.

8. Changes to These Terms

We may update these terms from time to time. If we make material changes, we will notify you by email or through the service. Continued use of GamePC after changes take effect constitutes acceptance of the updated terms.

9. Governing Law

These Terms of Service and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms, save that either party may seek injunctive relief in any jurisdiction to protect its confidential information or intellectual property. If you are a consumer, this does not take away the protection of the mandatory consumer laws of the country where you live.
